Areas under Family Law

There are many different areas that fall under the umbrella of family law. This can include things like divorce, child custody, and adoption. A family lawyer is someone who specializes in this type of law and can help you navigate the legal process.

Divorce in Family Law

No one gets married intending to divorce, but sadly, it is a reality for many couples. If you find yourself in this situation, you must navigate the family law system. This can be a daunting and overwhelming task, especially if you are already dealing with the emotional fallout of your divorce.

The first step is to find a good family law lawyer. This person will be your advocate and guide through the legal process. They will help you understand your rights and obligations, and they will represent you in court if necessary.

Once you have a family lawyer, the next step is to file for divorce. This can be done at your local courthouse. You will need to fill out some paperwork and pay a filing fee. Once your divorce is filed, your spouse will be served with the paperwork and they will have a chance to respond.

Child Custody in Family Law

This is the legal determination of who will have custody of minor children in the event of a divorce or other family law matter. Child custody can be awarded to one parent, both parents, or another relative or guardian.

Pakistani mothers usually have legal custody of their children under the age of seven, known as ‘Hizanat’.  Upon reaching the age of seven, a mother’s rights over her child end, but her right to raise him continues. A child’s interest is the driving force behind this right, not absolute rights.  Girls are given to their mothers until they reach puberty. If the mother’s conduct is found objectionable, she may lose custody of her child. After the mother’s term has ended, the court may grant the father custody of the child. Unless both parents are present, the child’s grandparents are awarded custody.

No matter what your specific situation may be, our family lawyer can offer guidance and support throughout the legal process. If you are facing a legal issue related to your family, consider consulting with our family lawyer to get started.

Property Division Disputes

This is the process of dividing up marital assets in the event of a divorce. All property acquired during the marriage is subject to division, including homes, cars, furniture, and retirement accounts.

Family Law in Islam

In Islam, family law is based on the teachings of the Quran and Hadith. Islamic law recognizes the importance of the family unit and protects the rights of spouses, children, and parents. Muslim families are governed by a set of rules known as the Sharia.

The Sharia covers all aspects of family life, including marriage, divorce, child custody, and inheritance. It is important to note that Islamic law is not a static set of rules – it is flexible and can be interpreted in different ways by different people.

There are a number of different schools of thought within Islam, each with its own interpretations of the Sharia. However, all schools of thought agree on the basic principles of Islamic family law.

If you are seeking advice on Islamic family law, it is best to consult with a qualified Islamic scholar or family lawyer who can advise you on the specific rules that apply to your case.

Four primary schools of Family Law in Islam

There are four primary schools of thought within Islam, and each has its own interpretation of how family law should be applied. These schools are Hanafi, Shafi’i, Maliki, and Hanbali. The vast majority of Muslims in Pakistan follow the Hanafi school.

Islamic law covers a wide range of issues including marriage, divorce, custody, inheritance, and guardianship. In Pakistan, there is also a system of secular laws which deal with some aspects of family law, such as divorce and child custody.

Family lawyers in Pakistan need to be familiar with both secular laws and Islamic laws in order to advise their clients properly. They also need to be aware of the different interpretations of Islam among the different schools of thought.

Family Law in Pakistan

Pakistan is a Muslim-majority country and as such, family law in Pakistan is largely governed by Islamic law. The main sources of Islamic law are the Quran and the Hadith (the sayings and traditions of the Prophet Muhammad).

In Pakistan, family law is governed by the Muslim Family Law Ordinance 1961. The Ordinance sets out the legal framework for marriage, divorce, custody, and other family matters for Muslims in Pakistan.

There are also a number of other laws that deal with related issues, such as the Child Marriage Restraint Act 1929, which sets the minimum age for marriage, and the Dissolution of Muslim Marriages Act 1939, which provides for the dissolution of Muslim marriages.
